CTC Approves Another $1.6B in Stimulus Money for California!
The California Transportation Commission (CTC) met on Wednesday, April 1st and approved another $1.597 billion in compliance with the American Recovery and Reinvestment Act of 2009 (Federal Stimulus Legislation). All of this money will be allocated to the various local transportation authorities throughout California. The largest single amount ($780 million) will go to the Southern California Association of Governments (SCAG), followed by the Metropolitan Transportation Commission ($320 million) and San Diego Association of Governments (SANDAG) at $131 million. In addition, the Doyle Drive project in San Francisco County was approved by the Commission for $50 million as a part of the Caltrans SHOPP program. This, together with a planned $300 million that will be used for some Proposition 1B projects will amount to $2.572 billion of the stimulus money that is planned for California.
Pavement Preservation Conference
The 2009 California Pavement Preservation Conference will be held next week on April 8-9, 2009 at the Oakland Marriott City Center, 1001 Broadway, Oakland, CA. The conference will cover all aspects of pavement preservation as well as pavement management systems.
This essential conference packs vital information about the full spectrum of preservation strategies, intensive training sessions, and opportunities to discuss solutions with colleagues into just a few days.
There will be new pre-conference training sessions on April 7 covering: 
- Pavement management fundamentals
- Asphalt fundamentals
- Concrete pavements
- Pavement preservation concepts

LA Contractors Dinner Meeting
The Los Angeles Contractors Committee will hold their next Dinner Meeting on Tuesday, April 14th in Pico Rivera at the Dal Rea Restaurant. This months guest speaker will be Michelle Loveall, Senior Vice President of First Regional Bank in Century City. Ms. Loveall will be discussing how the current credit market is affecting the contracting industry, contractors ability to secure loans, working lines of credit and other pertinent economic issues. The meeting will begin at 5:30 pm with a social hour and will conclude at 9:00  pm. This months Member of the Month will be one of our new Associate Members, Kenco Engineering Inc. APACA Board of Directors Meeting & Sacramento Fly-In
The next APACA Board of Director’s Meeting will be held on Tuesday, April 21st beginning at 10:00 am. Please note that this meeting will be held in conjunction with our Legislative Fly-In to Sacramento. The Board of Directors meeting will be held from 10:00 am until 2:00 pm and will follow with some late afternoon meetings with legislators. Please note that the meeting location has been moved to the CMTA Headquarters (see below for additional information). We have invited Assemblyman Mike Eng, who is the Assembly Transportation Committee Chairman, to have dinner with us that evening. The following day, Wednesday, April 22nd we will walk the halls of the legislature. Please plan on participating until 3:00 or 4:00 pm – at which time we will adjourn for the trip home. If you are planning on making the trip you should make your reservations as
soon as possible.

Caltrans Oil Price Adjustment Committee Meeting
The joint Caltrans / Industry committee that has been meeting to discuss issues relative to the California Statewide Paving Asphalt Price Index (CSPAPI) will be holding its next meeting in Anaheim at the offices of Sully Miller Contracting Company. Several meetings have already taken place and progress has been made on a variety of issues. This meeting should conclude discussions about the application of sales tax to the adjustment amount and how it will be administered. While Caltrans has agreed, in principle, to the addition of a sales tax element to the adjustment formula it has not been implemented. Some additional issues that remain unresolved are:
- If / how to adjust modified materials such as HMA containing rubber, polymers or other modifiers?
- Should an “opt-out” provision be provided in the specifications at bid time?
Items that have been agreed to include:

Use the three (3) current California crude posters (Chevron, Exxon Mobil and Conoco Phillips) for the three (3) California crudes used to develop the index. (implemented)

Use a monthly average of the crude postings instead of the 1 day “snapshot” to develop the monthly index. (pending)

Continue to use crude postings to develop the monthly index instead of some other methods proposed. (no action necessary)

Develop a uniform method for calculating the adjustment for monthly estimates that will be applied statewide. (implemented)

Change the “trigger” value from 10% to 5%. (implemented)

Change the 90%/10% cost sharing to 100% for Caltrans. (pending)

Add a sales tax element to the adjustment formula. (pending)

The Air Resources Board will be holding public hearings involving the implementation of AB 32 (the California Global Warming Solutions Act of 2006) on April 23rd and April 24th in Sacramento.
These hearings will allow members of the public to voice their opinions about the proposed regulation to reduce by 10% the amount of greenhouse gasses produced by transportation fuels used in California.
As drafted, the regulation will require the manufacturers of fuel (producers of electricity, natural gas, gasoline, diesel, ethanol, etc.) to reduce the amount of greenhouse gas emissions. While greenhouse gas reduction is an admirable goal, the proposed regulation poses a very real risk of lower supply and significantly increased costs to the consumer.
Many of the assertions made in the proposed regulation’s economic impact statement are based on overly optimistic assumptions about the future costs to build “green” refineries in many parts of the state. As such, it is important to make our voices heard about how we feel California can best meet its greenhouse gas reduction goals in a manner that doesn’t harm our economic growth.
The proposed regulation also anticipates a new Air Resource Board fee to be levied upon consumers to pay for the enforcement of the regulation.

Revised Caltrans Test Methods
The APA of California Technical Committees have been participating in a general review of several of the Caltrans Test Methods that have been undergoing changes and revisions. This joint effort between Caltrans and Industry has been a significant effort for many months and the individuals directly involved in the task groups who are doing the "real" work have devoted significant time and energy to the effort. The first group of test methods that have been revised is due to be posted on the Caltrans website very soon. We are told that the current target date is June 1, 2009. While this will not complete the effort, it will be a large portion of the various test methods that play a significant role in the HMA mix design process. You can find copies of the test methods, proposed final drafts and other information on the APA of California ftp site: ftp://HMA-ETG:kvRH95Tk@64.58.164.70. On this site you will find individual folderes for each of the task groups, one for the general review documents and one for the final draft.
Of particular note is the fact that Caltrans will begin expressing the oil content of a mix using percent by total weight of the mix as opposed to the percent by dry weight of aggregate. For some, this change will be a simple arithmetic calculation, for others it may be more significant. You should discuss this within your company to make sure that you are ready when the change occurs.

2009 TCC Legislative Fly-In

The new Congress and Administration have less than nine months to draft and approve legislation to reauthorize critical highway, bridge, transit and aviation construction programs. With the Highway Trust Fund’s balance essentially at zero, new revenue will be needed to provide the investment necessary to address current and future demands. The federal aviation programs also remain in limbo with new authorization months overdue.
The recently enacted economic stimulus legislation provides funds to keep state transportation programs moving forward and help boost our economy at this critical juncture. The responsibility for continuing the job retention/creation and other economic benefits of the stimulus measure’s transportation investments will fall to the next surface transportation reauthorization bill. This debate will be about more than economic recovery — it will also determine the future of the federal highway and transit programs.
The transportation construction industry cannot afford to sit back and wait for Washington to act. Now is the time to demand action from your Senators and Representatives about transportation needs in your state and the nation.

May 19th Propositions to Appear on Ballot
Last week we briefly commented on Proposition 1A that will appear on the May 19th Ballott. This week we would like to briefly comment on Proposition 1B. Proposition 1B would mandate supplemental payments of $9.3 billion to schools and community colleges. This figure is the difference between the amount actually appropriated in recent budgets, and the amount that, under some interpretations of California Proposition 98 (1998), should have been spent. If approved by a popular vote majority, the measure will only be enacted if California Proposition 1A (May 2009) also wins. That proposal would allow an extension of tax increases imposed as part of the Fiscal Year 2009-2010 budget agreement, resulting in an additional tax increase of some $16 billion.
