Consideration of Additional Extension on the Table 

Congress took no action this week to further extend a surface transportation authorization measure, leaving federal highway and transit programs operating under a one-month continuing resolution that expires Oct. 31.
States normally receive a full fiscal year's apportionment of contract authority for transportation projects on the first day of the federal fiscal year, Oct. 1. But this year, with the previous transportation authorization known as SAFETEA-LU having expired Sept. 30 and no new law in place, the Federal Highway Administration has distributed only one month's worth of funding thus far for Fiscal Year 2010.
There are essentially three options Congress can take this month to address the transportation funding crisis. It could approve a full six-year authorization measure, though this is considered difficult because of the scope and complexity of what needs to be done in three weeks. Congress could enact a multimonth extension of SAFETEA-LU to keep federal transportation programs operating at last fiscal year's funding levels. Or it could extend the continuing resolution funding most federal departments this month for another month or months if all appropriations bills are not completed by the end of October.
Failure to take any action would result in no additional money available for federal surface transportation programs as of Nov. 1 as the U.S. Department of Transportation would lack legal authority to fund them. This is considered unlikely, however, due to the crippling economic effects such a shutdown would have in all states.
State transportation departments suffered a double blow Oct. 1 when the new fiscal year began. Not only did they suffer an $8.7 billion rescission of previously granted highway contract authority, they also saw a $1 billion decline in the amount of highway formula funding available for the month because of complex budget-scoring rules that resulted in the continuing resolution containing only $2.03 billion in highway funds for October versus the $3.04 billion that states had been expecting based on Fiscal Year 2009 levels. That is the result of the $8.7 billion rescission carried out Oct. 1 combined with another $3.4 billion rescission earlier this year, which reduced the baseline funding for the highway programs by $12.1 billion. Thus monthly funding for the programs dropped by $1 billion.
The path forward is unclear now that SAFETEA-LU has expired and there is no new authorization in place. While key senators were willing last week to agree to the House's position favoring a three-month extension of authorization in exchange for repealing the $8.7 billion rescission, it's unknown what their next step will be now that the rescission has been implemented.                                                                         (Return to Top)  
CARB to Hold Public Workshop on Enforcement
 
The California Air Resources Board (CARB) will hold a public workshop on Monday, October 12, 2009 to discuss its enforcement policy.  In the public workshop notice, CARB indicates that it is interested in "exploring ways to achieve higher levels of compliance, expedite settlements, prioritize actions, eliminate economic advantage from violations, ensure consistent enforcement results, serve environmental justice communities, encourage voluntary compliance, increase access to ARB's administrative process and communicate the goals of ARB's enforcement program.  ARB is also interested in discussing strict liability for violations, model penalty policies , and ways to increase opportunities for public access, outreach, compliance assistance, and training "
 
The workshop will be held from 1:00 to 5:00 at the Cal/EPA Headquarters Building, Sacramento.  If you are not able to attend the meeting in person, it will be webcast.  The webcast link, additional information and public notice can be found online at:

 Section 39 Information Requested!!
 
We still need your input!  Both Caltrans and Industry have expressed some frustration with some of the requirements and administration of the new Section 39 specifications for HMA.  Information is being collected on all of the issues that both Caltrans and Industry are having with this new section of specifications, but we need your help.  We need the information from all of you in order to proceed with this effort.  A meeting will be held to discuss these issues in the very near future (no date has been established yet).  Rita Leahy, APACA Technical Director, will be the focal point for all issues that are submitted.  If you have specific issues that you believe should be brought to the attention of the committee, please forward them to Rita at rleahy@apaca.org.

2009 Asphalt Pavement Conference
 
The Asphalt Pavement Association of California is pleased to announce that this years Keynote Speaker will be Mr.Richard Land from the California Department of Transportation.  Richard is the Chief Engineer for the Department and will be adressing the group on issues concerning funding, the new Department of Pavement Management and other issues that concern our industry.  This will be a wonderful beginning to this full day conference on flexible pavements.
 
In addition, we are pleased to announce that the Southern Chapter of the American Public Works Association has agreed to support this years effort as a Sponsor.  We welcome the addition of this important group of industry representatives to this years conference and hope that their participation will contribute to the value of this years conference.  Please remember that all agency representatives can register for the conference at the same price as APACA members. 
 
We are especially pleased that the Asphalt Institute, Caltrans, the FHWA and National Asphalt Pavement Association (NAPA) will be co-sponsors of this year’s event.
 
 
The conference will be held on Thursday, November 5th, 2009 at the Doubletree Hotel in Ontario, CA.  This year’s conference will focus on the Sustainability of HMA and will include presentations on Warm Mix Asphalt (WMA), Recycled Asphalt Pavement (RAP), Cold-In-Place Recycling, Terminal Blended Binders, Asphalt Rubber Binders, Perpetual Pavement, Pavement Preservation and Agency & Contractor Experiences with Sustainable Technologies.  The Conference will feature sp eakers from California and across the country.  You will hear from Academia, Caltrans, FHWA, Texas DOT, NAPA, Local Agencies and Industry representatives.  For those traveling, hotel rooms will be available at conference rates.
 
Special Note for Caltrans Employees who wish to register for this year's conference.  You will need to follow some special directions to register for this years event.

2010 Annual Dinner Meeting
 
The Asphalt Pavement Association of California is pleased to announce that the 2010 Annual Dinner Meeting has been scheduled for Thursday, January 7th, 2010.  This year’s event will again be held at the Jonathan Club in downtown Los Angeles.  The Dinner will be preceded by some social time to renew old friendships and acquaintances beginning at 5:30 pm.  Dinner will be scheduled for 7:00 and will include a keynote speaker and recognition of industry members who have made significant contributions during the past year.  This is one of the highlights of the year and is always a wonderful event!

The Transportation Research Board is offering a Webinar on Wednesday, October 28 on "Estimating Stiffness of Subgrade and Unbound Materials for Pavement Design".  This is an opportunity to learn about some of the methods that are available for use for the new Mechanistic Empirical Pavement Design procedure.

Resilient Modulus is a primary input parameter used to characterize the subgrade and unbound bases in pavement design guides including the new Mechanistic Empirical Pavement Design Guide (MEPDG). However, laboratory determination of resilient modulus is complex and expensive. Hence, various empirical relationships are used to estimate stiffness parameters.

This webinar will explore intrusive and non-intrusive experimental laboratory and field test methods for the estimation of stiffness properties (resilient modulus) of subgrades and unbound materials for pavement design.  Panelists will summarize information about direct and indirect correlations that have resulted from these tests.  The panelists’ discussion will highlight information regarding moduli properties of materials, but it will not focus on ways to design pavement. This webinar is based off of TRB’s National Cooperative Highway Research Program (NCHRP) Synthesis Report 382: Estimating Stiffness of Subgrade and Unbound Materials for Pavement Design.
